EU Tax Blacklist: The February 2026 Update
- Updated on
- La rédaction
The short answer
On 17 February 2026, the Council of the European Union revised its list of non-cooperative jurisdictions for tax purposes: two additions (Vietnam, Turks and Caicos Islands) and three removals (Fiji, Samoa, Trinidad and Tobago). The next revision is expected in October 2026.
What has changed
The EU list has an Annex I (non-cooperative jurisdictions) and an Annex II (ongoing commitments, known as the grey list). In the revision of 17 February 2026, Vietnam and the Turks and Caicos Islands were added to Annex I, and Fiji, Samoa and Trinidad and Tobago were removed from it. Annex I now lists ten jurisdictions. On the grey list, Antigua and Barbuda and the Seychelles were removed, and Brunei obtained an additional six months.
Why it matters for a holding company
Several States apply measures to payments to the jurisdictions on this list. The Netherlands, for example, applies a conditional withholding tax to payments to low-tax jurisdictions and those on the EU list: see the page on holding company in the Netherlands. Checking the list before any transaction is therefore a useful reflex.
Next step
A new formal revision is planned for October 2026. We did not find confirmation that it had already taken place at the time this note was written: check the Council's publications.

How to use this list
- Before any international structure, check that none of the countries involved is on the EU list or the French list: see French ETNC list.
- Watch for updates: the list generally changes twice a year.
- Do not stop at the list: a country absent from the list may still fall under a preferential tax regime within the meaning of French law: see holding company and the French tax authorities.
For Andorra
Andorra's general rate is 10 %verified on 09/10/2026. Andorra does not appear on the French ETNC list in the order of 15 April 2026; the February 2026 updates of the EU list that we consulted name other jurisdictions. Check the list in force on the date of your transaction.
