How it works
- Three cumulative conditions are tested: percentage held, uninterrupted holding period and tax borne by the subsidiary.
- If they are met, the dividend is exempt from corporate tax; otherwise it is taxed at the general rate.
- The withholding tax of the subsidiary's country is deducted before the calculation.
- A message indicates what changes depending on the residence of the ultimate shareholder.
Assumptions and limits
- The exclusions (Andorran real estate, dividends deductible by the payer, non-deductible expenses) are not all modelled.
- The French tax of a French tax resident is not calculated: it depends on anti-abuse rules and on the facts.
- This is not tax advice: the burden of proving the conditions lies with the taxpayer.
