Employment law in Andorra: contract, probation, leave, notice and dismissal (Llei 31/2018)

The short answer

Llei 31/2018 sets a probation period of 2 months except in particular cases, a working week of 40 h, 30 days calendar days of leave, and dismissal without cause with notice of 12 days days per year worked and compensation of 25 days days of salary per year.

The framework

Employment relations are governed by Llei 31/2018 of 6 December 2018, published in the official gazette on 10 January 2019. A bill amending it was tabled before the Consell General at the end of October 2025: always check the version in force. This page presents the general law; collective agreements or the contract may be more favourable.

The two main contracts

ContractRule
Indefinite termNo time limit; the State must encourage this type of contract
Fixed term or for a specific taskMaximum duration of 2 yearsverified on 14/10/2026. Beyond that, the contract is deemed indefinite. If there is no fixed end date, written notice of 15 daysverified on 14/10/2026 is mandatory, failing which the termination amounts to unjustified dismissal

Special contracts exist: part-time, discontinuous seasonal work, short-term, by sessions, inclusion, and relief. Successive contracts separated by less than sixty days are added together for the purposes of the cap.

The probation period

It must appear in the contract. It cannot exceed 2 monthsverified on 14/10/2026, unless the agreed salary reaches three times the minimum wage (3 monthsverified on 14/10/2026 at most) or five times (6 monthsverified on 14/10/2026 at most). It is not possible if the employee has already held a post with the same characteristics with the same employer during the previous 3 yearsverified on 14/10/2026. During probation, either party may terminate at any time, in writing and in a verifiable manner.

Working time

  • Statutory duration: 40 hverified on 09/10/2026 of actual work per week, unless a more favourable provision applies.
  • Management staff and positions of trust are excluded from the working-hours regime but keep one full day of weekly rest.
  • Rest: 30 paid minutes for a working day of at least six continuous hours, at least 12 hours between two working days, one full day of rest per week, mandatory and non-waivable.
  • Overtime: possible within the limit of 12 hoursverified on 14/10/2026 per week, 48 hoursverified on 14/10/2026 per month and 426 hoursverified on 14/10/2026 per year, with the employee's free agreement; it is prohibited for minors and pregnant employees.

Leave and public holidays

Paid annual leave is at least 30 daysverified on 14/10/2026 calendar days a year (or 22 working days if the agreement or convention provides for it), pro rata to the time worked in the case of an incomplete year. Public holidays in the calendar are paid: see public holidays. Paid leave exists for family events: for example ten days for a marriage or civil union, three days for the death of a close relative.

The minimum wage

Set each year by the government: 1,568.66 €verified on 09/10/2026 gross per month since 1 July 2026. See minimum wage 2026.
